[In 24] It is true that, ordinarily, two sets of proceedings in respect of the one claim are vexatious and one of them should be stayed: see Reynolds v Reynolds [1977] 2 NSWLR 295. However, that is a general rule of practice to be applied when it improves the working of the procedures of the courts and is not to be automatically applied.
