63 An appeal to this Court from the District Court pursuant to the District Court Act 1973, s 127 is by way of rehearing: Supreme Court Act 1970, s 75A. The Court is required to assess and evaluate the evidence for itself, maintaining due regard for the advantage of the trial judge in having seen and heard all of the evidence: see Fox v Percy [2003] HCA 22; 214 CLR 118; CSR Ltd v Della Maddalena [2006] HCA 1; 224 ALR 1; Gett v Tabet [2009] NSWCA 76; 254 ALR 504.
