11 The absence of a tutor to represent the plaintiff was an irregularity that could be waived by the defendants: see, for example, Ex parte Brocklebank (1877) 6 Ch D 358 at 360; and Yakmor v Hamdoush (No. 2) [2009] NSWCA 284; (2009) 76 NSWLR 148 at [20].
